1. Acceptance of Terms

By accessing or using the website located at sanmarcosmasonry.com ("Site") or by requesting or receiving services from San Marcos Concrete & Masonry ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this Site or our services.

2. Description of Services

San Marcos Concrete & Masonry provides masonry contracting services including, but not limited to, foundation repair, chimney repair, tuckpointing, brick and stone work, retaining wall construction, driveway pavers, walkway construction, fireplace installation, and related masonry services. Services are performed at residential and commercial properties within our service area. Specific services, scope, and deliverables are defined in individual written estimates and agreements provided to each customer.

3. Estimates and Pricing

All estimates provided by San Marcos Concrete & Masonry are based on an on-site assessment of the work requested. Estimates are provided in writing and reflect the scope of work as understood at the time of assessment.

• Estimates are valid for 30 days from the date of issue unless otherwise noted.
• Price changes may occur if the actual scope of work differs materially from what was assessed, due to unforeseen conditions discovered after work begins. We will notify you and obtain approval before proceeding with any work outside the original estimate.
• Estimates are not guarantees of final cost where unforeseen conditions are encountered.

4. Scheduling and Cancellation

Scheduling is subject to availability. We make reasonable efforts to meet agreed-upon start dates but are not liable for delays due to weather, permit processing times, material availability, or other circumstances outside our control.

If you need to cancel or reschedule, please contact us as soon as possible at (442) 515-1809 or hello@sanmarcosmasonry.com. Cancellations made after materials have been ordered or work has begun may be subject to charges for materials procured and labor performed to that point.

5. Payment Terms

Payment terms are specified in each individual written agreement. In general:

• A deposit may be required before work begins on larger projects, as specified in the written agreement.
• Final payment is due upon completion of the work, unless otherwise agreed in writing.
• We accept payment methods specified at the time of estimate. All checks should be made payable to San Marcos Concrete & Masonry.
• Overdue balances may be subject to collection action and associated costs, including reasonable attorney fees where permitted by law.

6. Customer Responsibilities

You agree to:

• Provide accurate information about the property and the work requested.
• Ensure our crews have reasonable access to the work site on scheduled dates.
• Clear the work area as directed prior to scheduled start dates.
• Notify us promptly of any concerns about work in progress or completed work.

7. Permits and Code Compliance

Where required by local ordinance or building codes, San Marcos Concrete & Masonry will obtain necessary permits before beginning work. Permit fees, where applicable, will be itemized in the written estimate. We are not responsible for pre-existing code violations on the property that are unrelated to the scope of work we are performing.

8. Warranty Disclaimer

We stand behind our workmanship. Any warranty terms applicable to specific work performed will be stated in the written agreement for that project. Beyond any express warranty stated in writing, services are provided "as is" and "as available." We make no implied warranties regarding fitness for a particular purpose beyond those required by applicable law. We are not responsible for damage caused by pre-existing conditions, acts of nature, or circumstances outside our control after the work is completed.

9. Limitation of Liability

To the maximum extent permitted by applicable law, San Marcos Concrete & Masonry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of this Site or the services we provide. Our total liability for any claim arising from services performed shall not exceed the total amount paid by you for the specific project giving rise to the claim.

10. Website Use

The content on this Site is provided for informational purposes only. We make reasonable efforts to keep information current and accurate, but we do not warrant that the Site is free from errors or that it will be available at all times. You agree not to use this Site for any unlawful purpose or in any way that could damage, disable, or impair the Site or interfere with any other party.

If direct resolution is unsuccessful, disputes shall be submitted to mediation before either party initiates arbitration or litigation. These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these terms shall be brought in a court of competent jurisdiction in California.
